Hi, I want to get some advice.
I with AA insurance 3rd party. One day my car stopped at traffic light and the car behind me tried to change the lane and scratched me. At that time, we exchanged the contact details. Now the other driver told his insurance company that it was my fault and he declined his liability. When can I do? Thanks.

If you don't believe you were at fault (and from your description, it doesn't sound like you were), you will need to defend this matter at the Disputes Tribunal.
In the event you are found to be at fault, obviously, you will need to submit a claim to your insurer to pay for damage to the other vehicle.

I believe it was not my fault. Should I repair before going to tribunal or Should I go to tribunal before repairing it? or I need a quote then go to tribunal?
Should I also lodge a police report against the driver due to careless driving?

I really don't know which to do first. Thanks.

ABayliss

It would have been prudent to lodge a Police Report, but really this should be done within 48 hours of the incident. I'm not sure when it occurred, but may still be possible and wise to do so.
As far as the repair is concerned, you can have this done, then claim the amount at the tribunal.

Hi, How can I get the address from the other party? I have reg number, driver license number. But the other party or his insurance company refused to give the address due to privacy act. Thanks.

ABayliss

If you didn't get the address from the other party, the privacy act will pose something of an obstacle.
However, I have called the Ministry of Justice explaining that you have all the information except the address, and they have suggested that if you put all the info in an email to them at info@justice.govt.nz they may be able to assist. You could also call them on 04 918 8800 if you wish.
