Hi there, the other day I was driving along Te Atatu Road following another car. I would say i was about 2-3 seconds behind the vehicle.

It pulled to the left and came to an almost stop, it then tried to do a u-turn without any warning or indication and i crashed into it. Is the other car who did the u-turn at fault?

Exactly the same thing happened to me, I hit a car that "U" turned when exiting a round-a bout without indicating, I hit his vehicle directly in the drivers door, I was insured and he wasn't, he called the Police who told me to go home, he disputed the fact he was at fault, the damage to my car was in excess of $3,000, the Disputes Tribunal found in my favour, the comment from the mediator was the distance I would have covered in one second at the posted speed, the errant driver said he had indicated when stationary at the curbside, and then waited couple of seconds before making the turn without looking, it was the errant drivers duty to yield.

The driver proceeded to carry out a U-turn when it wasn't safe to do so and crossed the path of an oncoming vehicle - it would seem that the driver of the vehicle doing the U-turn is at fault.
