I have a 1988 Mazda Familia 323 and have put some 13" modgies on it. The tyre now sticks out beyond the car by about 35mm, is this alright or not?

How far can they protrude from the side of the car?

A couple of important points here. Firstly the tyre tread must be within the mudguard or guard extension. The side wall of the tyre can protrude outside the guard but not the tyre tread.

Secondly, you cannot increase the tracking width anymore than 25mm without obtaining a low volume certificate. Finally the wheels cannot interfere with the suspension, brakes or body components on the vehicle at any time and spacers cannot be fitted to the hubs to reposition the road rim.

It sounds to me like the car is illegal in this current modified state.

I suggest you visit the Low Volume Vehicle Technical Association website to see exactly what you can and can't do if you were to get LV certification.
