Hi there,
The car was left at the mechanics for two week to be repared and when it was picked up it was creshed in to. The mechanic left the car parked on the street and said that it was like this when he got it (which is not true). The car is not insured and the workshop apperently has no insurance either. Is the mechanic liable for the damage? Can we do anything the get the car fixed by the mechanic?
Thank you for your help in advance.
Kind regards
Orshy
Normally in these cases the owner of the vehicle would have to claim from their own insurance company for the repair. In this case the repairer did not do the damage to the vehicle and therefore are not liable – they normally have signs on the walls stating that they do not take responsibility for any damage for vehicles in their care. The vehicle was parked at the time and someone else has damaged the vehicle, not the dealer, and therefore it isn’t their liability to repair.
Unless you can prove otherwise you will have to pay for the repair.
