Hi, around this time of year you see alot of passengers riding in the tray of utes at the beach. Is this legal?

Drivers and passengers of a vehicle are legally required to wear seat belts. The information I have received from sources indicate having passengers unrestrained in the load area while driving is illegal - if seats and seat belts are not legally fitted. In the event of an accident the passengers will have nothing to protect them from being flung out of the load bin/tray and this potentially could have fatal consequences. A public access beach is classed as a road.
