If you are SLOWLY reversing out of your drive and the Postie on her bike runs into you on the footpath, denting and scratching your car, who is liable for the repairs?

We would not be prepared to say who is in the wrong or responsible for the repair costs.

No doubt the Postie will have their version of what happened and as people who use the footpath on a regular basis to carry out their jobs they would be well aware of such hazards.

Also a lot may depend on the actual point of contact.

The fortunate thing about this incident is nobody was hurt.

As the driver you do have the responsibility to look out for hazards such as pedestrians and young children on trikes etc.

If you have the Postie’s contact details a good idea would be to ask for a contact number of their supervisor/manager and to discuss the incident with them.
