I was hit from behind and it was established that I was not at fault. The vehicle I was driving was severely damaged to the extent that repairers have cut the back off my vehicle(from the back of the front seats) and intend to weld part of another which was in an accident but only has damage from drivers seat forward. The undamaged portion appears in a worse condition(rust etc) than mine. My vehicle was bought new 2006 and been driven mainly by my wife. Has 100000kms on clock been regularly serviced and maintained.
My question is can I request that the insurance company of the offending driver either offer another vehicle of the same type/condition etc or pay me current market value so I can purchase another vehicle of same type/age which has not undergone such dramatic damage. I am concerned that through no fault of my own I will have a vehicle which is in a lesser condition than that prior to the accident?. Also am I entitled to ask my insurance company to proceed along this line?
