Hi, just had an episode where I have seen a vehicle advertise both on trademe and the dealers own web page.

I thought it was a good deal but it did not strike me as being "too good to be true" just around the market rate abate a slighter lower than I had anticipated.

I phoned the dealer and said I was interested in the vehicle on a Friday and said due to other commitments I would not be able to see it until Monday. Circumstances changed and I visited the dealer on the Saturday morning.

took the vehicle for a drive and thought it would do and was going to about to negotiate the purchase when the sales man walked off for about 10 minutes without explaining why.

We are about to discuss the deal and I asked what price was as I could not remember if it was $20990 or $21990. I should mention there was no window card and it had been just traded.

He then said...there had been a mistake and the price was meant to be $29990 and that someone had entered a 0 instead of a 9.

They said they did not breached the Fair Trading Act as it was a human mistake.

Is that correct or should I take it further?

They have amended price on trademe but their website still shows the price I originally saw.

The following is taken from the Consumer Affairs website.

'Does a trader have to sell goods at the displayed price?

No, a trader doesn’t have to sell goods at the displayed price if the price is wrong.

But if a trader displays or advertises goods at the wrong price, they may be breaking the Fair Trading Act by misleading consumers about the true price of goods'.

You would have to make contact with the commerce commission to take this further.

It's up to you to decide whether the Dealer made a genuine mistake or has deliberately tried to mislead the public.

Bear in mind we all make mistakes from time to time. Their web site should reflect the correct price by now however.

A phone call or visit to the Dealer concerned to discuss this issue may help you decide.

You are correct, you have confirmed my thoughts , but I had doubts after several colleagues mentioned i might have recourse.

I am now aware that there is a specific term for misrepresenting prices to get people into store/yards and then changing parameters. I did believe it was a mistake, but thought the difference was bit much.

I have since had negotiations with the dealer and subject to a AA inspection we have reached an agreeable trade.
