Apon buying a car from a dealer who stated it was in "above average condition" and having it sent to Dunedin from Auckland....
It turned out the car was NOT in the condition the sales rep stated...Far from it.
I let the dealer know the day after we received the car ( less than 24 hours)
What are my rights to 1, Sending the car back
2, Getting a reinbursement for the car and sending it back
I have talked to the dealer and they are not willing to help me.

If the Dealer has deliberately misrepresented the car then you may have grounds for seeking a refund on the purchase price.

The term 'above average condition' however is open to all sorts of interpretation to be honest and there is always some responsibility for any potential buyer to seek an independent check to confirm a vehicles condition.

All sellers promote the positives about what they are selling whether it be a member of the public or, as in this case, a Registered Licensed Motor Vehicle Trader. They don’t tell lies but they don’t always point out the negatives either.

You don’t provide specific details of why you believe the car is not in the condition the salesperson described, so it’s hard to say too much more via this format.
