I purchased a 4wd vehicle just before lock-down with a freshly issued warrant(within a week). After going to see a mechanic I found out that the vehicle should have had a LVV cert pre-warrant due to it being lifted and turbocharged. I went back to the inspector and spoke with the branch manager who agreed to rectify the lack of a LVV cert.

It has since been inspected by the LVV technician and he found 2 rusted areas - one on the chassis rail and one on a panel within 300mm of a seatbelt mount and 150mm of a body mount. There were also numerous bushes that were worn, and the front drive shaft has excessive play in the slip joint.

Initially I was told that the rust on the chassis couldn't be fixed, but since found out that due to the age of the vehicle it can. The inspector approached me and asked if I was willing to pay for half of the repairs. I replied that since the repairs are all things that are checked in a warrant, as far as i'm concerned it is their responsibility to cover the cost of repairs seeing as they were there when the warrant check was done. I have yet to hear anything back from inspector.

I have spoken with NZTA, and even though they are the "authority" in charge of warrants, they "cant" enforce any action.

Has anyone else encountered this? Or have any information regarding this?
Is the inspector responsible for repairs? Are warrants covered by CGA?

The situation can be a bit tricky as to how the resolution is undertaken. Obviously a company was hired to provide a service (wof), however was it the previous owner hired them and paid for the work? And you purchased a vehicle that was advertised as having a new wof? (which would imply it's legally able to be driven on the road). The fact is wasn't could be deemed misleading which is one of the only covers a private sale has (false and misleading statements) as no CGA for private sales. Generally the one who contracted and paid for the service is the one who has all the rights using the CGA (the work contract/accounts won't have your name on it?)
