Hi there,
I had no full insurance when my parked car was hit by another vehicle. I got ahold of the other party and they have lodged a claim, my vehicle was assessed and has been deemed uneconomic to repair. I have been offered $2800 (and lose my vehicle) however I believe it's worth more. I am challenging this, and am presently awaiting a response on my challenge, but I feel that it would be within my rights to demand it be repaired. Will I be forced to accept the book value on this or do you think I have a case to demand more or repair?

Hi there,
Insurance companies have a threshold cost percentage of where they deem a vehicle uneconomical to repair vs vehicle value- I don't think demanding a repair will help in this situation. Insurance will ask for proof of value in a format they will accept, this is often difficult with a crashed vehicle. You may need to seek losses with the vehicle owner personally or in a dispute tribunal to make up the difference of your actual vehicle value vs what the insurance claim if you have no success.
