A driver (uninsured) ran into the side of my daughters car and damaged it. She got his registration and phone details, plus information about his car and where the accident took place. Her insurance company (Tower) unfortunately not AA, has now turned round and advised that he has refused to pay her excess and the Insurance company has told my daughter that she will have to pay. Is this usual practice or do they normally come to the party. Also should she have called the police at the time of the accident, he didn't give way at an intersection.

One common cause of frustration is when people are not at fault in a car accident, but still have to pay an excess,.

"If the other driver at fault is insured, and their insurer accepts they were at fault, the excess may be refunded . But, in many cases, the only way to recover the excess is through the Disputes Tribunal."
