Greetings. We purchased a brand new Mercedes Benz as a work vehicle. Since purchase we have had it serviced by our local specialist automotive shop, Capital Auto Ltd.
Mercedes Benz have long service intervals, I think of 40,000 km, but I feel this is too infrequent so I get it done every 15,000 km, as we are very fussy with our vehicles.
Now a fault has occurred, Mercedes Benz Wellington has said they will decline the warranty claim as we have not had it serviced through their dealership.
If I provide the with the receipts from Capital Autos, do you think I have a case?

The vehicle dealer can't stipulate that the warranty is void by not servicing at their dealership. The vehicle manufacturer is the one who has to give the vehicle warranty and the dealer carries out the repairs. As long as the manufacturers schedule has been adhered to and you have all the service history, they should look into claim. The problem may be the use of the vehicle with regard to warranty and the private or company use vs their terms and conditions.
