How long after an accident can the insurance claim the money from the guilty party (accident was not covered by a third party insurance at the time). The accident was reported, insurance contacted the guilty party and gave a verbal estimate of the damage, but never came back and claimed the money. Assumed that no repair has followed and if so then the damage might increase (rust getting in etc) over time, when does this expire by limitation or at least how do you make sure you are not held responsible for consecutive damage?

Hi there,
It would seem strange that the repairs have not been followed up. However it is unknown if the insurance claim actually went through, was accepted and excess paid. The only way you could find out is by contacting the insurance company to see what is going on, if an insurance claim is not completed, the a claim could be still made through a disputes tribunal for the costs of repair. I'm not aware of a timeframe of which a claim can be made.

Yes, this is why I am confused. The accident happened in early December and they have not come back about it ever since. The verbal quote was given in December and they inquired whether there was any diverging opinion on the incident and the party at fault (me). They said not to do anything further except for waiting for the bill to turn up to pay, which should be happening in January.
