I was wondering who I could claim from in the following scenario: Car A ran a red light. Car B (travelling alongside me and perpendicular to Car A) took evasive action avoid Car A, but in doing so, veered in to my lane. I could not avoid hitting Car B. All three cars subsequently crashed. Car A caused the whole accident, but if Car B had not swerved in front of me, I could potentially have avoided crashing. I am not insured, and I doubt the driver/owner of Car A is either. Can I claim from Car B’s insurer, as that vehicle was the most directly involved in causing me to crash?

Hi there,
The events in this scenario can get a bit tricky. If the car that hit into you did so while avoiding a collision (before actually being hit by the light runner) then they (car B) might be seen as responsible for your car and it would be advised to contact their insurance company. Without insurance working for you, this may be your best course of action. But if the light runner connected and pushed the other vehicle into you, then the runner could be found liable for both vehicles.
Police reports will indicate terms of events, accident responsibility and the issue of appropriate traffic infringements.
