I have just had my 2006 4-WD back to the franchise dealer to complete the routine 40,000km service.
One day later as we were driving on the motorway the vehicle broke down. Upon inspection by the dealer they acknowledged they had forgotten to replace one of the coolant hoses and the engine has overheated and potentially caused the cylinder heads to crack.
This is currently being investigated. There is no way I am able to know the extent of the damage and the necessary repairs at this stage.
I am also now concerned that any other damage may be unknown and that we might not have any comeback if problems were to develop in the future.
Please can you advise our legal right in this case. We had a perfectly performing car prior to the service and the subsequent overheat.

If the Dealer concerned has admitted to leaving a coolant hose disconnected after the service, then they are accepting liability for any damage caused as a result of the engine overheating.
You need to start keeping a detailed account of what actually happened (dates and mileage etc) and who has said what at the Dealership.
You have every right to be concerned about the condition and longevity of the engine because of the overheat as this condition is the worst possible failure for any engine to suffer as it can cause so many problems.
If the cylinder heads have cracked, I would definitely be concerned about possible damage to the engine bores and piston rings. An engine overheat can cause excessive oil consumption and tail pipe emissions due to damage to the bore and piston skirt surfaces and loss of ring tension.
I recommend you deal with the Dealer principal or business owner to discuss the best way forward on this matter.
If the dealer is a member of the Motor Trade Association (MTA) you may consider contacting them (0508 682 633) for independent advise also.
Certainly contact with the Dealer principal is the first step.
You need to be looking at a repair which restores the vehicle back to its previous condition and an agreed extended warranty period in writing.
I would also expect the dealer to provide you with a loan car while your vehicle is undergoing repair.
