I got an accident and it was 100% other driver's fault. My car was just 7 months old new car and the repair will cost more than 20,000 NZD so I worried even it is repaired, the value of car will be diminished. As nobody wants to buy the car had that big accident.

In this case, can I claim the diminished value to the other driver somehow? Can I request it to the insurance company?

I will appreciate for any advice.

Hi there,
it would be best to discuss options with your insurance provider. it is a bit of a tricky situation that is of no doing by yourself and so you shouldn't be left with a hard to sell vehicle. In saying that, the repair on a new vehicle should be such that no evidence of repairs should be found and the nature of the repair will be as demanded by the vehicle manufacturer.

Thanks for the answer. I'm trying to talk with my company AA but looks like AA is only interested in fixing my car which will leave me NICELY REPAIRED from heavy damage which sounds terrifying as this accident was not my fault at all.

You may need to determine cost values that could be attributed to "consequential" losses and seek remedy through a disputes tribunal if you believe insurance repairs are not enough- I think you would need to obtain written evidence of the loss in value with and without the accident history in order to substantiate any claim of loss.
