if a car is already registered 13months in NZ should I be liable to pay these costs again on purchasing this vehicle from a dealer?

No, generally speaking there are no ORCs for a car that has already been registered, WoF'd and on the road in NZ.

so if a car is advertised for say for instance 15000 + onroad costs which there isnt any, legally i should not be charged another $380 for this - would that be correct?

This is not a matter of what is legally chargeable, but I can't think what he could be charging $380 for. Just be direct with the dealer and ask what the $380 for ORC is when the car is already registered and on the road.
PS; The only thing I can think of is that if the dealer has had the car in stock for 13 months and it has never sold, then he could charge ORCs. (I was assuming that the car had already had a NZ owner, but maybe not?). If that's the case, why has it been in stock for so long?

Yes, the car has had a NZ owner and the current WOF and Rego expires in Feb 2014. The car was advertised in 2 ways, on TradeMe was the cost + on road expenses may apply, but the window price had onroad costs included but i only saw the online price until i was handed the window info when i went to do the paper work at which time i did question him and he replied "it is their way of advertising"

It seems that this dealer may usually sell new imports that are unregistered, hence advertising that "on road costs may apply" in all his ads. Obviously in this case they don't apply and the Consumer Information Notice was clear that there are no additional ORCs.
Therefore, you haven't been charged ORCs so it seems that there's no problem then?
