Morning, we are looking at buying a new family car. If we buy a car on a trademe auction from a RMVT does that still mean we're covered by the CGA? I know buying from Turners isn't covered so is it the same for any auction.

We have another couple who is interested in buying our Corolla. They are sorting out a loan through a finance company. How do we do a transaction for the sale- we've only done cash and a bank cheques before?

Under current legislation (which is under review) buying through any auction process means that the CGA does not apply (including TradeMe). However, most dealers sell on TradeMe with a listed price (ie; not an auction) so under those circumstances, the CGA applies.
Regarding the sale of your Corolla, the finance company payment will usually be in the form of a cheque from the finance company or a direct deposit into your account. Therefore, the deal between you and the buyer will proceed in much the same way it would if the buyer was funding the purchase themselves.

Wow I didn't know that it wasn't covered by the CGA, does this apply with the fair trading act also?
I purchased a vehicle 2 days ago sold by a RMVT from a $1 reserve on trademe. After getting it home I discovered that it had a towel stuffed in beside the power steering pump to slow the fluid leaking out. In the trademe add it did say "Only fault I've found is a oil leak coming from around the power-sheering pump unsure if its a hose or seal or cost of fixing sorry" (but someone obviously did to put the towel there), since I purchased it at auction does that mean that there is no comebacks ?

CGA does not apply, but Fair trading Act, Sale of Goods Act etc do. However, if the dealer said there was a power steering leak, then you really have no comeback.as it was disclosed.
