Hi I recently bought a car online at Turners Car Auction LMVD - the car was advertised by Turners as an “in- trade” sale. The cars WOF was issued 11 months before I bought it. Turners tell me that as the car was sold at auction they are not required to comply with the Consumers Guarantee Act and NZ Law stating that an in-trade car sale by a LMVD must have a WOF issued not more than 28day prior the buyer taking possession of the car.

Does anyone know if this is correct?

Hi there,
An "In Trade" purchase has to abide by the CGA and it can't be contracted out of, this is written into Turners buyer terms and conditions. It is also written that by agreeing to the terms, the buyer accepts the expiry date of the WoF/CoF if outside 28 days. https://content.tgstatic.co.nz/webassets/globalassets/company/terms-and-conditions/buyerterms_18.02.16v2.pdf
On 17th June 2014 the rules changed around the CGA being applicable to Auctions and Competitive tenders.

Thanks for your reply Cade, it aligns with the Manager from Turner's response. I was never disputing buying the vehicle just the issue regarding a LMVD's obligations when selling a vehicle. Its all rather confusing.
